Terms of service

The service

DiningEcho is a feedback collection platform for single-location restaurants in the United States. Restaurant owners ("Customers") subscribe to host a rating page where their diners ("End Users") can submit private feedback and optionally share publicly on Google.

User responsibilities

If you use the service as an End User, you agree to:

  • Provide truthful feedback that reflects your actual experience
  • Not submit content that is unlawful, defamatory, harassing, or fraudulent
  • Not attempt to circumvent rate limits or anti-spam protections

Restaurant responsibilities

If you use the service as a Customer, you agree to:

  • Comply with all applicable laws, including the FTC's rules on consumer reviews (16 CFR Part 465). You will not offer incentives in exchange for reviews and will not suppress negative feedback from public share invitations.
  • Treat End User contact information confidentially and only for follow-up about their visit
  • Not edit, delete, or fabricate End User feedback
  • Maintain a valid subscription to keep your rating page active

Acceptable use

You may not use DiningEcho to:

  • Send unsolicited marketing (SMS, email, or otherwise) to End Users
  • Operate as a review-gating, suppression, or filtering tool
  • Resell, sublicense, or scrape the platform
  • Interfere with service availability or integrity

Subscription, billing, and cancellation

Paid plans are billed monthly through Stripe. You may cancel at any time via the billing portal. After cancellation, your rating page remains active for a 7-day grace period; thereafter it displays an offboarding notice.

Limitation of liability

The service is provided "as is". To the maximum extent permitted by law, DiningEcho disclaims all warranties and is not liable for indirect, incidental, consequential, or special damages. Aggregate liability is capped at fees paid in the preceding 12 months.

Termination

We may suspend or terminate accounts that violate these terms, attempt to misuse the platform, or expose the platform or other users to legal risk.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles.
